These Terms of Use (“Terms”) govern your access to and use of the website located at rockport.net (the “Site”) and any services offered by Rockport Fiber, LLC, a Texas limited liability company (“Rockport Fiber,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

By accessing the Site, you represent that you are at least 18 years of age and have the legal authority to agree to these Terms. If you are accessing the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Rockport Fiber, LLC provides fiber-optic internet and telecommunications infrastructure services. The Site is used to provide information about our services, facilitate customer account management, and support business operations including billing and payment processing through integrated third-party platforms such as Intuit QuickBooks.

We reserve the right to modify, suspend, or discontinue any aspect of the Site or our services at any time without notice.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation;
  • Attempt to gain unauthorized access to any portion of the Site or its related systems;
  • Transmit any unsolicited or unauthorized advertising or promotional material;
  • Introduce viruses, malware, or other harmful code;
  • Harvest or collect personal information about other users without their consent;
  • Use the Site to infringe upon the intellectual property rights of others.

4. Accounts and Account Security

Our services integrate with third-party platforms, including Intuit QuickBooks, for billing and financial management purposes. Your use of any third-party platform is subject to that platform’s own terms of service and privacy policy. We are not responsible for the practices or content of any third-party services.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Rockport Fiber, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

7. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROCKPORT FIBER, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless Rockport Fiber, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, and you consent to personal jurisdiction in such courts.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in our Privacy Policy.

12. Modifications to These Terms

We reserve the right to update these Terms at any time. Changes will be effective upon posting to the Site with a revised “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
