These Terms of Use (“Terms”) govern your access to and use of the website located at rockport.net (the “Site”) and any services offered by Rockport Fiber, LLC, a Texas limited liability company (“Rockport Fiber,” “we,” “us,” or “our”). Rockport Fiber, LLC provides fiber-optic internet and telecommunications infrastructure services. The Site is used to provide information about our services, facilitate customer account management, and support business operations including billing and payment processing through integrated third-party platforms such as Intuit QuickBooks.

We reserve the right to modify, suspend, or discontinue any aspect of the Site or our services at any time without notice.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law or regulation;
• Attempt to gain unauthorized access to any portion of the Site or its related systems;

Your use of any third-party platform is subject to that platform’s own terms of service and privacy policy. We are not responsible for the practices or content of any third-party services.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROCKPORT FIBER, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

You agree to indemnify, defend, and hold harmless Rockport Fiber, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, and you consent to personal jurisdiction in such courts.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in our Privacy Policy.
